Terms of use

1.1These terms apply when you visit or use https://thecomposta.com (the "site"), which is run by Nutrify Private Limited (CIN U01611HR2026PTC145559), registered office 1st Floor, Plot No. B & B1, Vanijya Nikunj, Enkay Centre, Udyog Vihar Phase 5, Gurugram, Haryana 122016, India ("we", "us"), under the name The Composta.

1.2By using the site you agree to these terms. If you do not agree, please do not use it. These terms are an electronic record under the Information Technology Act, 2000 and need no physical or digital signature.

1.3Buying from us is governed by our Terms of sale (orders for delivery within India) or our Export terms (orders by businesses for delivery outside India), as well as these terms. Our Privacy policy and Cookie policy explain how we handle personal information and what the site stores on your device.

2.1Anyone may read the site. You must be 18 or over to send a quote request or place an order, because a minor cannot make a binding contract. If you are younger, please ask a parent or guardian to do it for you.

2.2You may use the site to learn about our products, build a quote list, request a quotation and contact us. You agree to use it lawfully and to give accurate information when you send us a request.

3.1You must not:

1. copy, scrape or harvest the site's content or data by automated means, except for ordinary search-engine indexing;
2. interfere with the site or the servers behind it, or send it malicious code;
3. probe or test the site's security except as our Security notice allows;
4. send us false, misleading or unlawful requests, or use the site to send spam or to impersonate another person or business;
5. use the site in a way that would breach any law, or the rights of anyone else.

3.2We may limit or block access to anyone who does not follow these rules.

4.1We do not publish prices. The packs, descriptions and any figures on the site are an invitation to ask for a quotation, not an offer to sell. Adding a pack to your quote list does not reserve stock or commit either of us. The list is kept in your browser, on your device, until you send it.

4.2Sending a quote request through the site is a request for a quotation only. It is not an order. After you send it, the site opens a WhatsApp message with your request ready to send, and we reply with a written quotation, usually within one working day.

4.3A contract for the sale of goods is made only as set out in the Terms of sale or the Export terms: by our written quotation, your written acceptance of it, and our receipt of the payment agreed in it. Acceptance by email or by WhatsApp message is enough. The Information Technology Act, 2000 recognises a contract made by electronic communication as valid and enforceable, and we treat such acceptances in the same way as a signed document. We never treat silence, or a box ticked for you, as acceptance.

5.1We take care that the information on the site is accurate and up to date, but it is general information. Usage and dosage guidance is based on common agricultural practice and published agricultural guidance. It is a starting point, not advice for your particular soil, crop or situation. A soil test is the best guide to what your soil needs. Please read our Product information and safe-use notice before you use the product.

5.2Images on the site are drawings and illustrations unless we say they are photographs. They show the idea of a product or process and are not a guarantee of how any particular batch looks.

5.3Importing a soil amendment is restricted in some countries. Information on the site about where we ship is not a promise that a shipment can enter any particular country. Our Export terms explain who is responsible for import permits.

6.1All content on the site, including the text, drawings, illustrations, layout, logo, the name The Composta and the line "Richer by nature.", belongs to Nutrify Private Limited or is used with permission, and is protected by copyright and other laws. Nothing on the site gives you any right to use our name, logo or tagline.

6.2You may view the site, print a page for your own use, share a link to it, and quote a short extract with a clear credit and a link back. You must not copy, adapt, sell or publish any other part of it, or use our name, logo, drawings or tagline in a way that suggests you are us or are endorsed by us, without our written permission.

6.3Distributors and resellers who want to show our brand must ask first at export@thecomposta.com or contact@thecomposta.com and follow the brand rules we give them.

7.1The site links to services we do not run, such as WhatsApp and our social media profiles. We do not control them and are not responsible for their content, availability or privacy practices. A link is not an endorsement. A message you send through WhatsApp is handled by WhatsApp under its own terms and privacy policy as well as ours.

8.1We aim to keep the site available, but we do not promise that it will be uninterrupted or free of errors. We may change, suspend or remove any part of it, and update these terms, at any time. The version on the site on the day you use it applies to that use. A quotation you have already accepted stays on the terms that applied when you accepted it.

9.1The site and its content are provided as they are. To the extent the law allows, we do not give any warranty that the site is error-free, secure or suitable for your purpose.

9.2To the extent the law allows, we are not liable for any indirect or consequential loss, or any loss of profit, income, data or opportunity, arising from your use of the site. Our responsibility for goods you buy from us is set out in the Terms of sale or the Export terms, not here.

9.3Nothing in these terms excludes or limits our liability for fraud, for death or personal injury caused by our negligence, for the liability of a manufacturer or seller for a defective product or for inadequate instructions or warnings under Chapter VI of the Consumer Protection Act, 2019, or for anything else that cannot be excluded or limited by law. Nothing in these terms affects your rights as a consumer under that Act or any other law that applies to you.

9.4If you misuse the site and that causes us loss, you are responsible to us for that loss.

10.1We may suspend or end your access to the site at any time if you break these terms or the law. The clauses that by their nature should continue, such as those on our content, responsibility and governing law, continue after your access ends.

11.1If any part of these terms is found to be invalid or unenforceable, the rest continues in force. If we do not enforce a right straight away, that does not mean we have given it up. These terms, with the policies they refer to, are the whole agreement between us about use of the site. You may not transfer your rights under them; we may transfer ours to a successor of the business.

11.2We give notice to you by email or by posting on the site, and you give notice to us at contact@thecomposta.com or 1st Floor, Plot No. B & B1, Vanijya Nikunj, Enkay Centre, Udyog Vihar Phase 5, Gurugram, Haryana 122016, India. These terms are in English; a translation is for convenience only.

12.1If you have a complaint about the site, an order or how we have handled your personal information, write to our Grievance Officer at support@thecomposta.com. The Grievance Officer's details, how we acknowledge and resolve complaints, and where you can go if we cannot resolve one are in our Grievance redressal policy. We acknowledge a complaint within 48 hours and aim to resolve it within one month.

13.1These terms are governed by the laws of India. If a dispute arises, please first write to our Grievance Officer so that we can try to resolve it under our Grievance redressal policy. If we cannot, the courts at Gurugram, Haryana have jurisdiction.

13.2If you are a consumer, you do not have to use our complaints process first, and you may also bring a complaint before any consumer commission that has jurisdiction under the Consumer Protection Act, 2019, including online through e-Jagriti. Nothing here removes a mandatory right you have under the law of the country where you live.
